Ready to appeal
AGU must appeal the court decision that suspended the release of R$1.5 billion in extraordinary credit. Last Wednesday, judge Candice Galvão Jobim, from the 2nd Federal Court Special Data of Brasília, granted an injunction, in a popular action proposed by deputy Raul Jungman (PPS-PE) against President Luiz Inácio Lula da Silva and the Minister of Planning, Paulo Bernardo.
According to Gazeta Mercantil , the objective of the popular action proposed by the deputy was to suspend the effects of Provisional Measure 324, which released extraordinary credit of more than R$1.5 billion for various purposes, including the “updating of the single registry and the control of compliance with the conditions relating to the Bolsa Família Program, as well as the payment of this benefit”.
Industrial property
A movement led by the Brazilian Association of Industrial Property Agents wants to strengthen the qualification process of the workforce directly involved in the intellectual licensing process. Together with the National Institute of Industrial Property, the federal body responsible for registering trademarks and patents, the association is working on drafting a draft with the aim of consolidating all sector legislation into a single bill. According to Gazeta , among other things, the new law would require a higher education diploma for candidates for the position of industrial property agents.
Imelda's trial
The Philippine Anti-Corruption Court wants to judge Ferdinand Marcos' widow, Imelda, and her three children as responsible for the crime of illegal appropriation of state resources committed by the late dictator, in an amount that according to the government amounts to around US$1, 02 billion. The government is working to recover the fortune allegedly embezzled by Marcos while in power, estimated at US$10 billion, reports Gazeta Mercantil .
The case was opened in 1987, two years before Marcos' death, and refers to influence peddling that benefited the dictator and businessman Vicente Chuidian, one of his allies. The Court has already dismissed two appeals filed by Imelda and her children, who argue that they no longer had responsibility for Marcos' actions after his death in 1989.
Companies are going to the Federal Supreme Court to try to avoid the return of tax benefits considered unconstitutional by the Court. The idea is that the STF removes the obligation for benefits to be returned to the State retroactively and thus determines a date that causes less damage, publishes the newspaper Valor Econômico .
Contribution in dispute
Also according to Valor , the 1st Section of the STJ should soon judge the dispute over the union contribution collected by the National Confederation of Agriculture. The case is one of the court's biggest disputes, with around four thousand cases, but it was held up for almost a year due to a conflict of jurisdiction with the Superior Labor Court.
With the creation of the Labor Court's jurisdiction for union issues, the STJ tried to send its processes to the neighboring TST. The STF, however, frustrated the operation and the STJ was tasked with resolving the dispute, a reason for divergence between the 1st and 2nd Panel of the Court.
